Welcome to SIGEX ("Signal Execution"), a web-based automated options copy trading platform ("Platform", "Service"). These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and the operators of SIGEX ("we", "us", "our", "Operator").
BY CLICKING "I AGREE" OR USING THIS PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS SERVICE.
1. BETA SOFTWARE DISCLAIMER
1.1. SIGEX is currently in BETA. This means the software is experimental, actively under development, and not considered production-grade financial software.
1.2. Bugs, errors, downtime, unexpected behavior, data loss, and service interruptions can and will occur.
1.3. Features may be added, modified, or removed without notice.
1.4. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. NOT FINANCIAL ADVICE
2.1. SIGEX and its operators are NOT registered investment advisors, broker-dealers, financial planners, or fiduciaries under any jurisdiction.
2.2. Nothing on this Platform constitutes financial advice, investment advice, trading advice, or any other sort of professional advice.
2.3. All trade signals displayed or executed through the Platform originate from independent third-party signal providers and do not represent recommendations from SIGEX.
2.4. You should consult with a qualified financial advisor before making any investment decisions.
3. ASSUMPTION OF RISK & NO LIABILITY FOR LOSSES
3.1. YOU TRADE AT YOUR OWN RISK. The Operator is not responsible for any financial losses, damages, or costs arising from your use of this Platform, including but not limited to losses from:
- Trades executed automatically (whether correctly or incorrectly)
- Signal parsing errors or AI misinterpretation of trade signals
- Delayed execution, missed signals, or failed orders
- Robinhood API changes, outages, rate limits, or rejected orders
- Bugs in position sizing, stop-loss logic, trailing stops, or order routing
- Third-party signal provider errors, bad calls, or fraudulent signals
- Data feed delays or incorrect price data from market data providers (e.g., Polygon.io)
- Server downtime, network issues, deployment failures, or infrastructure outages
- Partial fills, slippage, or unfavorable execution prices
- Account restrictions, margin calls, or pattern day trader violations on your brokerage account
3.2. IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
3.3. THE OPERATOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
4. THIRD-PARTY SIGNAL PROVIDERS
4.1. Trade signals copied by SIGEX originate from independent third-party traders on Discord ("Signal Providers").
4.2. SIGEX does not endorse, verify, audit, or guarantee the accuracy, reliability, or profitability of any Signal Provider.
4.3. Past performance of Signal Providers does not guarantee future results. Performance statistics displayed on the Platform are based on paper trading simulations and may not reflect actual trading results.
4.4. Signal Providers may have conflicts of interest, including trading against their own signals.
5. BROKERAGE CREDENTIALS & DATA SECURITY
5.1. To enable live trading, you may provide your Robinhood brokerage credentials to the Platform.
5.2. All credentials and session tokens are encrypted at rest using industry-standard Fernet encryption (AES-128-CBC with HMAC-SHA256) and stored in a secured PostgreSQL database.
5.3. You acknowledge the inherent risk of providing brokerage credentials to any third-party platform, regardless of encryption measures in place.
5.4. You may disconnect your brokerage account and permanently delete all stored credentials and session data at any time through the Platform's Settings page.
5.5. The Operator will not sell, share, or disclose your credentials to any third party. Credentials are used solely for executing trades on your behalf as directed by the Platform's automated systems.
5.6. The Operator is not liable for any unauthorized access to your account resulting from vulnerabilities beyond our reasonable control.
6. OPTIONS TRADING RISK
6.1. Options are complex, high-risk financial instruments. You can lose your entire investment.
6.2. Options trading is not suitable for all investors. You should only trade with capital you can afford to lose entirely.
6.3. Past performance — whether from Signal Providers, the Platform's paper trading, or any other source — does not guarantee future results.
6.4. You are solely responsible for understanding the risks associated with options trading before enabling live trading on this Platform.
7. AI & AUTOMATION RISK
7.1. Trade decisions on this Platform are partially or fully automated using artificial intelligence (AI) models, including but not limited to GPT-4o-mini and LLaMA.
7.2. AI can make mistakes, misinterpret signals, produce incorrect position sizing, or fail to recognize market conditions.
7.3. Automated systems can malfunction, execute trades at unintended prices or quantities, or fail to execute when expected.
7.4. The Operator does not guarantee the accuracy, reliability, or performance of any AI-powered feature.
8. USER RESPONSIBILITIES
8.1. You are solely responsible for:
- Monitoring your own brokerage account and open positions
- Setting appropriate risk parameters (max trade amount, stop losses, position limits)
- Understanding every trade being executed on your behalf
- All tax reporting and compliance with applicable tax laws
- Ensuring you meet your brokerage's requirements for options trading
- Complying with all applicable securities laws and regulations
- Maintaining the security of your account credentials
8.2. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement.
8.3. You represent that you understand the risks of automated trading and options trading as described herein.
9. INDEMNIFICATION
9.1. You agree to indemnify, defend, and hold harmless the Operator, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:
- Your use of or inability to use the Platform
- Any trades executed or not executed through the Platform
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any claim by a third party related to your use of the Platform
10. TERMINATION
10.1. The Operator reserves the right to suspend or terminate your access to the Platform at any time, for any reason, without prior notice.
10.2. You may terminate your use of the Platform at any time by disconnecting your brokerage account, clearing your stored data via the Settings page, and ceasing to use the Service.
10.3. Upon termination, the Operator will delete your stored credentials and session tokens. Certain data (e.g., trade history, usage logs) may be retained for legal or analytical purposes.
11. MODIFICATIONS TO TERMS
11.1. The Operator reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform.
11.2. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
12. GOVERNING LAW & DISPUTE RESOLUTION
12.1. This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
12.2. Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12.3. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Operator.
13. MISCELLANEOUS
13.1. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
13.2. The failure of the Operator to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.3. These Terms constitute the entire agreement between you and the Operator regarding the use of the Platform.
